Your manager or companys HR department may ask you to make a formal request to take your resignation back. This may be a simple form that the human resources department needs you to fill out or a formal letter withdrawing your resignation.
If the employee is covered by a formal employment contract or collective bargaining agreement, the resignation date generally cannot be changed. In this situation, both sides have agreed to the terms of the agreement.
For example, in California, when an employee resigns, employers must provide final pay within 72 hours. However, if the employee who resigns provides at least 72 hours of notice, final pay is due on the employees last day.
Know your legal rights A retraction of resignation is possible. However, if you have made a clear oral and/or written statement indicating an unambiguous decision to resign, specified an end date for your employment and begun serving your notice, an employer is legally entitled to reject your retraction.
If your employee chooses to rescind their notice, and you want to keep that employee around, you can do so without issue. You are not legally bound to fire them, and, if you do, the employee may be able to sue for wrongful termination.
How to react when one of your employees resigns Stay calm and dont panic. Dont take it personally. Find out what their reasons for leaving are. Start writing the job description. Communicate the news across the team. Seek the exiting employees support if required. Conduct a formal exit interview.
Depending on your employers policy, your boss doesnt have to accept your request to withdraw your verbal resignation. However, if your employer requires a written resignation as a condition of resigning, your boss shouldnt hold you to a verbal resignation that you made and now want to rescind.
If you submit a letter rescinding your resignation, it is up to the employer to decide whether you can stay or if theyll uphold the terms of your initial resignation notice.
