In 2017, rent control was extended to all private residential units in Ontario under the Rental Fairness Act.
This means that if you move into an apartment, condo, or basement unit that was first tenanted as a residential space after the amendment of the Residential Tenancies Act, 2006 (RTA), the landlord does not have a limit on how much they can raise the rent to.
Units are exempt if they are restricted to be affordable for low- or moderate-income residents. A single family home is exempt unless its owned by a real estate investment trust (REIT), a corporation, or an LLC where one of the members is a corporation.
New residential apartment buildings, condos or houses that were occupied for the first time as of November 15, 2018, are not rent controlled. Landlords can increase the rent year-to-year to whatever they want and they are not required to follow any guidelines.
AB-1482 also exempts single-family owner-occupied homes, including residences in which the owner-occupant rents or leases no more than two units or bedrooms, that are not owned by corporations or real estate investment trusts.
New buildings, additions to existing buildings and most new basement apartments that are occupied for the first time for residential purposes after November 15, 2018, are exempt from rent control. What Units Qualify for the Exception? There are two types of units that qualify for the exemption.
Units exempt from the just cause regulations Single-family, owner-occupied residences where the owner rents no more than two bedrooms or units, including accessory dwelling units and junior accessory dwelling units.

If the apartment is not ready for you to move in on the agreed date, you may either demand that the landlord do what needs to be done to meet the standards and comply with the lease or you may terminate the rental agreement upon at least five days written notice to the landlord.
Is your single-family home or condo exempt from Californias statewide rent cap and just cause for eviction provisions under the Tenant Protection Act (AB 1482)? If so, make sure you have provided the required notice to your tenant.
