You must tell the Intellectual Property Office ( IPO ) if any of the details held in the trade mark register need updating or correcting. You must also tell IPO if you want to give up your rights to your trade mark or appoint a representative or agent.
If you filed your logo in color, and later decided to use a different color, your trademark would no longer protect you. That's one of the limitations of filing in color. So, you will need to file a new trademark, preferably for a logo in black and white (without any color claim), if you haven't already done so.
Words that don't serve to identify the source of a product can't be trademarked. Generic words, offensive words, and certain proper names can't be trademarked. Words that are already trademarked for goods within the same industry can't be trademarked.
The 20 Percent Rule. If you're interested in trademarks and design, you may have heard that you only need to alter a logo by about 20 to 25 percent in order to claim it as your own. It can be inspired by a logo that already exists and is in use as long as it differs enough that it appears to be its own design.
It is possible to modify your logo any time after filing your trade mark application. However, there are limitations to how much you can amend it. There are also differences in amendment processes. Generally, the proposed amendments will need to be made in writing and will need to be considered fair and reasonable.
The U.S. Patent and Trademark Office does not allow the registration of generic words or phrases. For instance, a computer repair company cannot trademark the word "computer." It is considered generic and too likely to be used in the course of daily business for a multitude of businesses in the same industry.
Logo redesigns are a good way to reflect a fundamental change in your business, introduce a new name, or even reconnect with your target audience if you see that your current brand isn't effectively doing so.
If the modified mark contains the "essence" of the original mark, material alteration has occurred. The basic change that occurs is small enough that it creates the same commercial impression. Alteration in this manner is copyright infringement.
Once a trademark application has been filed at the trademark registry, the applicant cannot request for changing the logo in a trademark application. A change in the graphical representation of the trademark may be possible if the trademark registry directs the applicant for the same.
A: If you filed a design mark application with a color specimen and registered it with color, the registration protects that specific design exactly as filed. Changing the color will remove the design or logo from the umbrella of protection offered by the USPTO registration.
