In this video, Beta Delesi discusses the process of evicting a tenant for late rent payments. A landlord can file a notice and application with the Landlord and Tenant Board if a tenant is consistently late. They must serve an N8 notice for persistently late payments, which includes a 60-day termination date and a rent roll summary indicating a pattern of late payments—ideally showing at least six to seven late payments within the past year. The landlord will then file the N8 notice, rent summary, and L2 application with the Board. Upon receiving these, the Board sets a hearing date and issues a hearing notice, with typical wait times for this process.

If any payment is late, the Landlord can obtain an eviction order under section 78 of the RTA. 9. For all these reasons, tenants should generally be given an opportunity to start paying on time where they promise to do so, as is the case here.
If your tenant is late paying by even one day, or the rent is short by any amount of money, the landlord has the right to serve them with a 10 day eviction notice for non-payment of rent. Tenants have 5 days to dispute their eviction and apply for dispute resolution after receiving a 10 day notice.
