What is an advance decision? An advance decision (sometimes known as an advance decision to refuse treatment, an ADRT, or a living will) is a decision you can make now to refuse a specific type of treatment at some time in the future.
Is an advance statement legally binding? No, an advance statement is not legally binding, but anyone whos making decisions about your care must take it into account.
When I get the next chest infection, that will happen this winter, I would prefer to be left at home. However if I get admitted to hospital I will hope that I will be given oral antibiotics but no more active treatment. Specific details of the treatments I wish to refuse are in my Advance Decision.
An Advance Statement allows you to record your wishes, feelings, beliefs and values in case you later become unwell and need care or medical treatment. It provides a space for you to write down anything thats important to you in relation to your health and wellbeing.
There is no need for a will to be drawn up or witnessed by a solicitor. If you wish to make a will yourself, you can do so. However, you should only consider doing this if the will is going to be straightforward.
An advance statement lets you make general statements, describing your wishes and preferences about future care, should you be unable to make or communicate a decision or express your preferences at the time. You may want it to reflect religious or other beliefs and important aspects of your life.
The difference between them is that advanced statements can include general information about your day-to-day care, and advanced decisions/directives are used to refuse specific medical treatments.
Yes you can change your advance decision at any time, and the Mental Capacity Act does not have a particular way for you to do it. You may need to change your advance decision because your circumstances have changed since you made it. For example, you may have: got married or entered a civil partnership.
