Merchants have historically used signatures on receipts as a record of transaction to protect against fraud or chargeback. But the industry has since moved away from that standard. These days, if a place asks me to sign a receipt, its probably because they havent migrated yet to EMV.
The merchants have to keep them as proof purchase, should a dispute from the card holder be lodged. The merchant typically has 5 days to provide the acquirer with proof of payment, or, failing to do so, the merchant is debited the amount and effectively loses the money.
There are no legally binding terms on your merchant processing agreement about signing credit card receipts. So, you no longer need to obtain a signature from your customers for their credit card transactions. Regardless of the dollar amount.
Moreover, its proof of the transaction. So, its essential for restaurants to keep them. Especially, if there are false chargeback requests or disputes.
For decades, credit card companies relied on receipt signatures to prevent fraud. They required merchants to collect and store customer signatures so that if a transaction was disputed, the merchant could produce a signed receipt proving the customer was physically in the store and personally approved the purchase.
Both parties should sign the document (or alternatively, neither should sign). By having each party sign an invoice or sales receipt, the document is formalized. Just remember, the signatures dont necessarily make the transaction any more legally-binding than the invoice itself.
