You can change a power of attorney if you are competent and you are the one that created the power of attorney then you can change it. Have you ever wondered, If a relative is no longer able to sign their checks, may I sign for them? The safe answer is yes if you have been granted power of attorney (POA) for your relative. POA gives you the legal ability to handle any financial transactions on their behalf including writing checks.
You may revoke the power of attorney by executing another writing revoking the power of attorney or by creating a new power of attorney and expressing that the new power of attorney will revoke any previous authority given.
After the principals name, write by and then sign your own name. Under or after the signature line, indicate your status as POA by including any of the following identifiers: as POA, as Agent, as Attorney-in-Fact or as Power of Attorney.
Write Pay to the Order of and the third partys name below your signature. Its important to write the name of the person that you are signing the check over to in the endorsement area under your signature.
The power of attorney can permit an agent to act on the principals behalf in financial matters such as filing taxes, selling property, refinancing a mortgage and depositing or cashing checks.
To revoke a POA or make changes to the existing form, a new form must be filed. If you would like to revoke a POA in its entirety without executing a new one, submit a signed statement of intention to revoke to the specific person you are working with at DOR, through MassTaxConnect or by fax to 617-660-3995.
