A surprise medical bill is an unexpected bill from an out-of-network provider or at an out-of-network facility. Effective January 1, 2022, the No Surprises Act may protect you from surprise medical bills under certain circumstances. Medical debts often occur after an accident or sudden illness.
A surprise bill happens when a patient unknowingly or unavoidably receives health care from providers outside their insurance companys network and is billed directly for that care.
While you have an obligation to file claims in a timely manner, you cannot do so without the patient providing correct information. If the claim is denied because the patient did not provide accurate information, but you acted in good faith, you should balance bill the patient.
Surprise billing is not uncommon. By some estimates, as many as one-fifth of all emergency room visits involve out-of-network care. One study estimates that out-of-network billing raises the cost of specialty physician care for employer-sponsored health insurance by approximately 3.4 percent or $40 billion.
The No Surprises Act protects people covered under group and individual health plans from receiving surprise medical bills when they receive most emergency services, non-emergency services from out-of-network providers at in-network facilities, and services from out-of-network air ambulance service providers.
