Employees have a right to privacy regarding their personal medical information. Employers should only release medical information to staff who need it for a specific purpose.
Under Ontarios Employment Standards Act, 2000 (ESA), your employer can ask you to provide a sick note from a registered health practitioner as long as the request is reasonable.
In Alberta, your employer can ask you to provide a sick note as long as the medical information requested: Relates to the operation of the workplace and your job duties. Is relevant to the time period of a related absence (a request for past medical history is generally not allowed)
An employer is entitled only to the least such information necessary for the purpose and an employee should generally not be required to disclose their medical files, or even diagnosis or treatment.
Employees have the right to keep their medical information confidential and private. But employers also have the right to know about their employees illness or disability, and have the right to seek medical information in order to provide appropriate accommodation.
An employer can ask for a doctors report about their employees health if its needed to stick to the law. For example to: assess whether the employee is fit to carry out their work. prevent health and safety risks.
The employee does not have to disclose disability-related or other needs or medical information that do not relate to the essential duties of the job. Employees should not be singled out for questioning based on their appearance instead, ask all employees the same questions about accommodation.
If requested, an employee is expected to make every reasonable attempt to get a medical note to explain the absence. The employer will usually request a medical note for longer absences.
If youre off work sick for 7 days or less, your employer should not ask for medical evidence that youve been ill. Instead they can ask you to confirm that youve been ill. You can do this by filling in a form yourself when you return to work. This is called self-certification.
