Unfortunately, under United States patent law you can not amend the patent to include the new subject matter reflecting the improvement you made to the invention. You will have to file a new patent application for the improvement to the invention instead of filing an amendment to the patent.
Patent rules forbid the addition of new matter once an application has been filed, so any modifications to the specification should serve to clarify or possibly delete subject matter. For example, you might be able to edit a paragraph to specify a feature that was shown in the originally filed drawings.
A replacement sheet is a sheet that is used when the figures with defects are replaced with the modified figures. As per the U.S. Patent and Trademark Office (USPTO), every replacement sheet of a patent drawing must comply with 1.84 and should include all the figures that appear in the original version of the sheet.
Amendments in provisional applications are not normally made. If an amendment is made to a provisional application, however, it must comply with the provisions of 37 CFR 1.121. Any amendments to a provisional application will be placed in the provisional application file, but may not be entered.
There is a surcharge for filing the basic filing fee or the cover sheet on a date later than filing the provisional application. Amendments are not permitted in provisional applications after filing, other than those to make the provisional application comply with applicable regulations.
Change of Owner (Assignment) and Change of Owner Name The original owner should record the assignment or name change with the USPTOs Assignment Recordation Branch by going to Assignment Center and filing a Recordation Cover Sheet along with a copy of the actual assignment or proof of name change.
a description and a claim or claims; drawings, when necessary; an oath or declaration; and prescribed filing, search, and examination fees.
Amendments to Claims You can change the claims of a patent without filing a new application unless you are making a new claim. If you are making a new claim, you will need to file a new patent application.
