A Model Release Form establishes a contract between the photographer and a model, defines how and where photographs may be used and the basis of any remuneration. It protects both the photographer and the model in the event of any dispute provided the parties have abided by the terms of the release.
What is a model release? In the photography industry, a model release is a binding legal agreement between a photographer and their model or any potentially recognizable human subjects. This agreement ensures that everyone is aware, feels compensated, and has consented to this type of usage.
In nearly all circumstances the creator of the artwork, the artist, is the owner of the copyright, and the ownership of it can only be transferred by that person, in writing. But, a model retains the right to deny certain uses of their likeness, unless they have signed a release giving up that right.
Its important to always obtain a signed model release form prior to shooting, regardless of whether the model is paid or unpaid. Even if you dont have any plans to license the photos, an opportunity may present itself well after the shoot.
A model release form is a liability waiver signed by a model, actor, or other performer that grants a production entity the right to commercially publish their name, voice, image, likeness and/or performance within specific, agreed-upon terms. In other words, its a legal contract.
Its important to always obtain a signed model release form prior to shooting, regardless of whether the model is paid or unpaid. Even if you dont have any plans to license the photos, an opportunity may present itself well after the shoot.
A model release is actually a very simple release. It could really be done in 2-3 sentences, and if signed by the person photographed, would be valid. Some model releases go WAY overboard with confusing and unnecessary language that sometimes can scare people away from being willing to sign one.
Most releases tend to not have an expiry date, so be sure to check before you sign. If you signed one 20 years ago, the chances are it still stands today.
HOW LONG SHOULD I KEEP A RELEASE? The department sponsoring the activity must keep releases for at least three years after the activity ends. Releases signed by a parent or guardian on behalf of a minor must be retained for at least three years after the activity ends or until the minor turns 20, whichever is longer.
Why do you need a model release? The contract itself provides a photographer with the right to use any photographs taken of the model (that session) for any editorial trade, advertisement, or any other manner.
