Once finalised, the parenting plan must be signed. Keep in mind that parenting plans need to be approved by the court before it is legally binding on parents. The parenting plan can be incorporated in a divorce settlement or registered at the Childrens Court of the Family Advocates office.
Changing or modifying your parenting plan or otherwise changing custody in Tennessee after a divorce requires asking the Court for a modification. In order to qualify for a modification of custody, the parent seeking the change must prove a change of circumstances which materially alters the childs well-being.
The statute provides for a review and potential adjustment of child support every two years. If 24 months have passed from the date of the entry of the child support order or since the last modification (whichever is latest), the order may be adjusted without a showing of substantially changed circumstances.
A determination of parental responsibility, a Parenting Plan and a time-sharing schedule may not be modified without a showing of a substantial, material, and unanticipated change in circumstances and a determination that the modification is in the best interests of the child(ren).
