It is generally accepted in our trust law that a trust deed can be amended in two ways without the interference of the courts. The first way is in terms of the common law and the second way is in terms of a variation clause in the trust deed itself.
If there is no amendment clause in the Trust Deed, any amendment has to be done with the permission of a Civil Court. Once the Civil Court has allowed permission for amendment, it is not open on the part of the Income Tax Officer or any other person to challenge such amendment.
A trust may be modified if there is an unforeseen circumstance, such as changes in the law or a beneficiary develops serious health problems, that substantially impairs or defeats the settlors intent, and all the beneficiaries agree to the modification.
The trustees have no power to alter, amend or vary the trust purposes, whether on the ground of expansion or addition or enlargement of the objects of the trust.
To modify an irrevocable trust, you can either decant the trust or initiate a court procedure through a California probate court. With the latter, you will need to petition the court to allow the modification to the irrevocable trust. It is also possible to include a trust protector provision in an irrevocable trust.

Modifying an Irrevocable Trust under California Law Under Probate Code 15404(a) any trust may be modified or terminated by the written consent of the settlor and all beneficiaries without court approval of the modification or termination.
In scenarios where the founder of the trust deed is still alive, then it can be amended through the powers afforded to the trustee in terms of the deed itself or in terms of the law of contract by which a later agreement between the founder and trustees amend substitute an earlier agreement between the same parties.

The trustee usually has the power to retain trust property, reinvest trust property or, with or without court authorization, sell, convey, exchange, partition, and divide trust property. Typically the trustee will have the power to manage, control, improve, and maintain all real and personal trust property.
