You don't usually need to give notice to leave on the last day of your fixed term. If you stay after the fixed term, you'll have a periodic tenancy. Check what notice you need to give when you have a periodic tenancy.
One year is most typical. If you break the lease, you're breaking a contract, and the landlord can hold you responsible for paying the rent until the end of your lease term. For example, if you pay $1,800 a month and want to break your lease for the last four months, you could end up on the hook for $7,200.
What happens when a tenant's lease expires? Once a lease expires the tenancy becomes month to month. The tenant is still required to provide 60 days notice to terminate the tenancy.
Your landlord can get a court order to make you pay the rent you owe. You'll usually have to pay the court costs as well as the rent you owe. Leaving without giving the correct notice could also make it harder for you to find a new home because: you may not be able to get a reference from your landlord.
If you rent by the month or by any longer period, your landlord must give you at least 60 days' written notice. If you pay by the week or day, your landlord must give you at least 28 days' written notice. The notice should be on a form called Notice to End your Tenancy at the End of the Term (Form N8).
If you pay rent by the day or week, you must give 28 days notice (for example, if you want to leave on March 1, you have to give notice by February 1). If you pay rent by the month, you must generally give 60 days notice. If your lease is fixed for a period longer than a month, you must generally give 60 days notice.
When Breaking a Lease Agreement is Legally Justified in Ontario. Generally speaking, an Ontario tenant cannot end a tenancy agreement before the period ends.
Your tenancy becomes periodic automatically if you stay past the end of the fixed term without a renewal agreement. A joint tenancy becomes periodic if any of the joint tenants stay on, unless there's a new agreement in place. A periodic tenancy continues on the same terms and you should pay your rent as normal.
