If you paid a deposit at the start of your tenancy, you have the right to get it back at the end. Your landlord or letting agent can only take money off if theres a good reason - for example if youve damaged the property. Youll need to contact your landlord at the end of your tenancy and ask them for your deposit.
By law, deposits in England are limited to no more than five weeks rent. If you have a standard private tenancy or Assured Shorthold Tenancy (AST) your landlord or agent must protect the deposit in a government scheme within 30 days of receipt and pass the details on to you.
There is a strong chance that they will lose their security deposit and there is a likelihood that the landlord may take legal action against them or against any guarantor provided by the tenant to ensure that the tenant is ordered to pay the rent for the period the property was vacant.
A new landlord will usually take on the responsibility for the return of the deposit and must comply with the rules of the deposit protection scheme.
Under the Rent Control Act, the security deposit should be kept in a bank under the lessors account name during the duration of the lease and any and all interest earned by the security deposit shall be returned to the lessee at the end of the lease.
