In the eyes of the law, unconscionable terms are those that shock the conscience. For example, if the prenup states that one party keeps all the assets acquired before and during their marriage and the other party receives nothing in return, the Court may not enforce at the time of divorce.
Prenups last, usually by their terms, for the entire length of the marriage. However, prenups sometimes include provisions that expire. The most common one might be an agreement that theres going to be no spousal support unless they are married for at least 10 years.
If you can prove that your spouse did not fully disclose their assets, that failure to disclose is grounds to have the prenuptial agreement invalidated. The same is true for debt disclosure. If you discover your spouse has more debt than recorded in the agreement, it may be grounds to have the agreement invalidated.
A prenuptial agreement in California can always be changed, as long as both spouses sign off on the modification. If something changes, such as your marital property or number of children, and you wish to update your prenup with the most recent information, you and your spouse must both agree to make the change.
A deep dive into the 7-day rule Section 1615 (c)(2)(B) of the California Family Code mandates that prenups executed after January 1, 2020, have at least seven calendar days between the time that party was first presented with the prenup in its final form and the time that the prenup is signed.
Generally, the answer is that there is no expiration date. Youll need to show the prenup is invalid for reasons other than the length of the marriage. Youll need an experienced family lawyer who aggressively fights to protect your marital property interests and fights for alimony, child custody, and child support.
