Can you patent a new use for an old product? You cant patent an existing or old product. However, you can patent an improvement to an old product or a new use for an existing or old product as long as the new use is nonobvious. Moreover, the new use cannot be inherent in the use of the existing or old product.
Patent Term Adjustment (PTA) is a process of extending the term of a U.S. patent. Its intention is to accommodate for delays caused by the USPTO during the prosecution of a U.S. utility or plant patent application. The total PTA is an addition to the 20 year lifespan of the issued U.S. patent.
Unfortunately, under United States patent law you can not amend the patent to include the new subject matter reflecting the improvement you made to the invention. You will have to file a new patent application for the improvement to the invention instead of filing an amendment to the patent.
Amendments to the specifications -- the written description of the patent -- must be made by adding, replacing or deleting a paragraph, by replacing a section or by a substitute specification.
111(a) (other than a design application), the claim for priority must be presented during the pendency of the application, and within the later of four months from the actual filing date of the application or sixteen months from the filing date of the prior foreign application. This time period is not extendable.
How Much Can You Change to Avoid Patent Infringement? Many people undervalue patents these days because they mistakenly believe they can avoid infringement by changing their product by some percentage, such as 10 to 30 percent. Theres no rule about how much you can modify a product to avoid infringement.
You can change the claims of a patent without filing a new application unless you are making a new claim. If you are making a new claim, you will need to file a new patent application. Federal regulations governing the USPTO provide specific rules for amending patent claims.
If you own a patent, you have possession of a product or design and others cannot make, sell, or use it. The U.S. Patent and Trademark Office (USPTO) grants patents for improvements made to existing products or innovations similar to already-patented products.
Hence, the life span for a patent in India is 20 years from the date of filing the patent application. You simply cannot extend the life of the patent. After its lifespan expires, the invention no longer enjoys patent protection and the invention becomes a part of the public domain.
If a response is not filed within two months after the date of a final office action, the USPTO calculates extension fees from the mailing date of the final action and does not extend the filing deadline to respond even if and examining attorney fails to respond in a timely manner.
