When an employee gives a two-week notice of resignation, can an employer terminate the individual immediately? While employers are not required to honor an employees resignation notice period, there are several issues to consider before making the notice date an employees last day of work.
Employers can make changes to the contract of employment provided they have the employees consent or are permitted for example under a flexibility clause.
If an employee has been dismissed and wants to leave during the notice period, the employer can agree to reduce the employees notice period. If an employer doesnt agree to reduce the notice period, the employee can choose to resign and give their own minimum notice.
If the employee is covered by a formal employment contract or collective bargaining agreement, the resignation date generally cannot be changed. In this situation, both sides have agreed to the terms of the agreement.
Changing the start dates If there is a binding contract in force between the parties (oral or in writing), delaying the start date of employment would amount to a change in contractual terms.
