Under the regulations, retroactive designation is permitted if an employer fails to timely designate leave as FMLA leave (and notify the employee of the designation).
Here are some tips for returning to work after medical leave to help you prepare: Maintain open communication. Create a plan. Meet with HR. Ask about fitness-for-duty certifications. Inquire about changing your schedule. Thank your coworkers. Prepare for questions. Be kind to yourself.
It is at the departments discretion whether to allow you to return to work earlier than expected (except FMLA leaves which only requires you to give two days notice of intent to return to work). Normally, your department should permit you to return to work early unless no position is available.
As long as it is medically necessary for you to take time off intermittently, the FMLA gives you the right to do so.
Leave of Absence means any period during which an employee does not receive (i) compensation for employment, (ii) service credit towards pension benefits, and (iii) health insurance benefits paid for by the employer.
Return from Leave . Employees who take leave shall be entitled, on return from leave, to be restored to the position of employment held by the employee when the leave commenced or be restored to an equivalent position with equivalent employment benefits, pay, and other terms and conditions of employment.
Common reasons are childbirth, adoption, caring for an ill family member, serious health conditions or military leave. In cases such as these, employees may be entitled to leave by federal or state law.
When employees exhaust twelve weeks of FMLA leave and still cannot return to work due to their own medical impairment, the employer may have an obligation under the ADA to grant additional unpaid leave as a reasonable accommodation, in some situations.
