3. The Standard Bylaws A strata corporation will initially have the Standard Bylaws contained in the Act unless they have been amended by the Owner Developer at the time the strata plan was filed. The strata corporations bylaws apply to a section unless they have been amended by the section.
In many cases, the easiest way to change the bylaws of a society is to repeal the existing bylaws entirely and substitute a new set of bylaws. The new bylaws should be submitted to the Registrar attached to a resolution adopting the bylaws which has been certified by a director or officer of the society.
A bylaw revision is a major overhaul of the bylaws. It is done when there are too many changes to be made through the amending process. Organizations should be constantly reviewing their bylaws to see if it meets their current needs.
The proposal should include: A statement of the purpose and rationale for the proposed changes. A side by side presentation of the proposed changes. The left column should show the current text and the right column the proposed strikeouts and/or revisions. A clean copy of the proposed final, revised text.
The amendment is then presented, discussed, and voted upon. In contrast, a revision is used when changes are so extensive and general that they are scattered throughout the document (or documents). Unlike an isolated amendment, a revision is a substitution of a new document.
Bylaw Amendment means an amendment to a zoning bylaw, an official community plan bylaw, or a Regional Growth Strategy bylaw.
To officially amend (create, change or delete) bylaws, the strata corporation or section must file the change on a Form I: Amendment to Bylaws at the Land Title Office. New and changed bylaws do not take effect until they are filed at the Land Title Office with the exception of pet bylaws.
