The trademark application can be expedited by filing a petition to make special. By filing the petition to make special, your trademark application is examined out of turn. Your trademark application will be examined about 2 to 4 months after it is filed.
You can modify the trademark youre using on your products and services, but you cannot modify an existing registration, so unless you register your newly modified trademark, it will not have the same scope of protection as a prior, unmodified, registered trademark.
Use Electronic Trademark Assignment System (ETAS) to request the change. If youre filing a TEAS form within the next week, you may need to manually update the owner information on the TEAS form.
Trademark applicants must wait until they have been given official approval from the USPTO before using the registered trademark symbol (). Although using TM or SM is allowed at any time, using the registered symbol while a trademark is still pending is a criminal or civil offense in many jurisdictions.
You can request to change some information in your trademark application after your examining attorney approves your trademark for publication and before your trademark is registered. However, not all changes are allowed.
There are two initial application filing options: TEAS Plus - $250 per class of goods/services. TEAS Standard - $350 per class of goods/services.
If you find an error in your filing receipt immediately after submitting your form, contact the Trademark Assistance Center. If your error is not correctable, you may need to file a new application. However, your filing fee will not be refunded. The filing fee is a fee for processing your application.
However, after your trademark is registered, you can request changes by filing a Section 7 Request for Amendment or Correction of Registration Certificate form.
