On May 9, 2023two days before the Secretary terminated the Section 319 PHEHHS issued the Eleventh Amendment to the Declaration. This amendment, first announced on April 14, 2023, extends PREP Act immunity for certain COVID-19 countermeasures through December 31, 2024.
The PREP Act authorized a Covered Countermeasures Process Fund to compensate eligible individuals who suffer injuries as the direct result of a countermeasure administered or used under the Declaration.
The terminology can be confusingfor example, the World Health Organization still calls COVID-19 a pandemic, even after declaring an end to the public health emergency last spring.
The PREP Act created the CICP to provide compensation to individuals who sustain a covered serious physical injury or death as a direct result of the administration or use of a covered countermeasure (or to estates and certain survivors of such individuals).
