After obtaining a court order granting a name change, you should update important identification records, including your drivers license or other state-issued identification, birth certificate, Social Security card, and your passport.
That is why it is critical that each employees name and SSN, as shown on their Social Security card, match your payroll records and year-end Forms W-2. The Internal Revenue Services Publication 15 (Circular E, Employers Tax Guide) contains instructions for recording employees names and SSNs.
You are not required to update Form I-9 when your employee has a legal change of name. However, it is recommended that you maintain correct information on Forms I-9 and note any name changes in Section 3.
After obtaining a court order granting a name change, you should update important identification records, including your drivers license or other state-issued identification, birth certificate, Social Security card, and your passport.
You may accept a document with a different name than the name entered in Section 1 as long as the document reasonably relates to the employee. You also may attach a brief memo to the employees Form I-9 stating the reason for the name discrepancy, along with any supporting documentation she provides.
Employers: If an employee legally changes his or her name because of marriage, employers should continue to use the old name and tell the employee to contact Social Security to obtain an updated card.
Employers should continue using the Form I-9, Employment Eligibility Verification, after its expiration date of Oct. 31, 2022 until further notice. DHS will publish a Federal Register notice to announce the new version of the Form I-9 once it becomes available.
Form I-9 regulations do not require that an employee present you with documentation to show that the employee has changed his or her name.
