The applicant for the patent can make a request to the Controller to add a person as one of the inventors, if such person is also the applicant or is at least one of the applicants. As a best practice, it would be wise to submit to the Controller, consent of all the applicants, in case of joint applicants.
No limit provided you are all inventors. However, including a party who is not an inventor may render a patent invalid (although it is a correctable error).
However, although the name of the first inventor may indeed be the 'lead' inventor or reflect a political standing, the order of the inventors on a patent application has no legal consequences and all named inventors are co-inventors with equal rights.
Patent law gives co-owners of a patent the right to make, use, license, sell and import the patented invention within the United States in whatever way they please, without the consent of the other co-owners. Joint ownership of a patent occurs simply by applying for a patent with other people.
A patent transfer is usually accomplished through a contract, like the written agreement form that follows. However, after the parties have negotiated and signed their agreement, the transfer must be recorded with the U.S. Patent and Trademark Office (USPTO).
INDIVIDUAL AND JOINT OWNERSHIP Alternatively, it occurs where all parties having ownership interest (all inventors and assignees) assign the patent property to one party. Joint ownership - Multiple parties may together own the entire right, title and interest of the patent property.
Under Section 28(7), only those who were added as inventors as a consequence of the request(s) discussed earlier, can be removed. Such a request may be made by any person, and at any time.
CHANGE OF APPLICANT Any request to change the applicant must include an application data sheet under 37 CFR 1.76 specifying the applicant in the applicant information section in ance with 37 CFR 1.76(c)(2) and must comply with 37 CFR 3.71 and 3.73.
A patent transfer is usually accomplished through a contract, like the written agreement form that follows. However, after the parties have negotiated and signed their agreement, the transfer must be recorded with the U.S. Patent and Trademark Office (USPTO).
During examination of a pending patent application or after the patent is granted, the owner of the patent may change: 1) the original owner may transfer ownership to another entity or party, through an "assignment;" or 2) the original owner may retain ownership but change its name.
