I, [name], a resident of the County of [county], State of [state], declare that this is the codicil to my last will and testament, which is dated [date original signed]. I add or change said last will in the following manner: [List all specific changes or additions to the original will.
Unless you are doing multiple wills (see Multiple Wills, below), generally you should revoke all prior wills when you make a new one. Revocation should be done expressly in the text of the new will.
What are living wills in Canada? Living wills are legally binding documents that indicate the future personal wishes of a person if they become incapacitated. It outlines a persons preferences regarding their medical treatment and personal care when they cannot expressly state these preferences.
Codicils typically are drawn up by a lawyer. In Canada, it is possible to make changes to your Will by crossing things out or adding new information with a handwritten amendment. However, there are very stringent requirements for these changes. It must be signed by you and the witnesses who originally signed your Will.
Sign and date the codicil or new will in the presence of at least two adult witnesses who are not beneficiaries of the will. Witnesses must also sign and date the document to confirm its authenticity. Once you complete this step, your codicil or new will is legally binding.
It is very common for people to come to LegalWills.ca wanting to update an existing Will that has previously been written by a lawyer. Often a lawyer will quote $500 or more for updating a Will. This seems unreasonably high, particularly when the changes are minor amendments rather than a complete re-write.
Any obvious alterations on the face of the will are assumed to have been made at a later date and so do not form part of the original legally valid will. The only way you can change a will is by making: a codicil to the will or. a new will.
Put your wishes in writing To be legal, the codicil has to meet the same requirements as a will. For example, it must be in writing, dated, and signed by you and two witnesses. You dont have to use the same two witnesses you used for your will. The codicil must refer to the will (and previous codicils) its amending.
