You cannot use a name thats been trademarked. Its also illegal to use another nonprofits name in the same state. You will have to do thorough research on the possible names youve thought of.
Answer: A 501(c)(3) public charity is generally permitted to change its mission and purpose and undertake new program areas that were not described in its Form 1023 application so long as these changes are consistent with 501(c)(3) status and properly disclosed in the organizations Form 990.
To change its legal name, the corporation must file a certificate of amendment with the secretary of state or an amendment to its registration. See Form 424 (Word 135kb, PDF 129kb) or Form 406 (Word 100kb, PDF 306kb), as applicable.
