Rental Application Fees: Landlords are allowed to charge a non-refundable rental application fee. However, the fee cannot exceed the actual costs of screening tenants. Additionally, landlords must provide applicants with a written receipt for any fees paid. RCW 59.18.
The landlord may charge for carpet cleaning or painting if there are damages caused by the tenant beyond normal wear and tear. Providing documentation of the condition of the unit may be useful in the case that the tenant and landlord disagree whether the damages were normal wear and tear or caused by the tenant.
In Washington, a landlord is not allowed to charge a cleaning fee unless it is specifically provided for in writing in the rental agreement. Even then, the landlord is not allowed to make charges that are due to wear and tear.
Landlords are generally prohibited from locking a tenant out of the premises, from taking a tenants property for nonpayment of rent (except for abandoned property under certain conditions), or from intentionally terminating a tenants utility service. Various penalties exist for violating these protections.
3. Washington state eviction laws are changing. Statewide, in 2024 landlords and tenants will be able to request that their eviction hearing is held remotely. The courts will need to grant a request unless there is a reason for needing them to attend in person.
Late Fees: Landlords may charge a reasonable late fee of less than $20 or 20% of the rent, whichever is greater (RCW 19.150. 150). Grace Period: 5 days (RCW 59.18. 170).
