Also called operations fees, service charges are mandatory fees automatically added to restaurant bills in California. Customers cannot elect to not pay the service charge because it is part of the bill.
These surcharges, which typically range from 3% to 5%, are often intended to cover higher inflation, employee healthcare costs or credit-card processing charges. And to be sure, all businesses are entitled to recover their operating costs. But this isnt how you do it.
Upcharge is used as the billing counterpart to marketings upsell. In one context, it means paying a smaller increment in price for a larger increase in what is received; in another it means paying an increase for a non-standard arrangement, what one writer called upcharge money.
It is legal for restaurants to charge a cancellation fee, provided it is clearly communicated to the customer and is considered reasonable given the context of the booking.
In most places, its not legal for restaurants to charge more than the prices listed on their menu without warning.
It also violates the California Business Professions Code, which makes it unlawful to charge a customer for an amount greater than the amount advertised, posted, marked, or quoted for that item and to charge a customer for an amount greater than the price posted on the item itself or on a shelf tag.
Theres a myriad of reasons for the increasing prices. Ingredient costs have gone up, as have salaries, which many restaurants increased to compete for staff after pandemic shutdowns. Regulations squeeze from all sides, and commercial rents are market-defyingly high.
In most places, its not legal for restaurants to charge more than the prices listed on their menu without warning. Prices displayed on menus are typically considered an offer, and when a customer orders from that menu, it forms a contract. Changing the price without notice could be considered deceptive or fraudulent.
