Minnesota became the fourth state to completely ban non-compete agreements with employees. On July 1, 2023, Minnesota will join California, North Dakota, and Oklahoma in the small (but growing) group of states that impose a full ban.
If you find the non-compete agreement too broad, restrictive, or unfair, you can try to negotiate the terms with your employer. You can ask for a shorter duration, a smaller geographic area, a narrower definition of competition, or an exemption for certain activities or clients.

If your non-compete has terms that are excessively restrictive, it may not hold up in court. Tricked or Coerced into Signing Under Duress: If you were coerced or tricked into signing the non-compete agreement under duress, it is likely invalid.
Typically, the only way to fight a non-compete agreement is to go to court. If you are an employee (or former employee) who signed such an agreement, this means you must violate the agreement and wait to be sued. It may be that your former employer has never sued another employee to enforce the non-compete agreement.
Employers who have non-compete clauses in contracts with current employees or former employees employed after January 1, 2022, were required to notify those employees by February 14, 2024, that the non-compete clause is void.
