If you have a written employment agreement, changes to these terms should be in writing and agreed to by both parties. If your employer tries to modify the terms of a written employment agreement without your awareness or acknowledgement, the changes will not be binding on you.
A contract amendment allows the parties to make a mutually agreed-upon change to an existing contract. An amendment can add to an existing contract, delete from it, or change parts of it.
Generally speaking, an employer in Ontario cant make docHub or negative changes to an employees job or the terms of their employment, without their permission. This includes: A cut in pay, salary, commission or bonus.
If you dont agree with changes to your employment conditions. If you dont agree, your employer is not allowed to just bring in a change. However, they can terminate your contract (by giving notice) and offer you a new one including the revised terms - effectively sacking you and taking you back on.
Both you and the employee or worker can propose changes to the agreed terms and conditions, but you must both agree to the changes. In some circumstances, you might have an agreement with a trade union that allows the union to negotiate and agree certain contract changes on behalf of employees and workers.
Cancelling or changing contracts requires mutual consent of all parties and a document in which the changes can be recorded so that they remain binding in law. Although we cant provide a solution for the former, we do provide several alternatives for the latter, so you should be able to find one that meets your needs.
The legal doctrine practically everywhere is a contract is always open to renegotiation and amendment when the parties mutually agree that is the way forward. But in the real world in the context of employment contracts, its just not going to happen until perhaps at a much later date.
If your contract outlines that you may resign at any point of the contract, then you are free to give your employer your notice without any complications. The contract indicated that the employer must accept your resignation, which means legally, the employer must respond ingly.
