HIPAA doesnt actually allow people to correct their medical records instead, it provides people with a right to amend the record by adding in additional information. But if a person wants to remove erroneous information, that person is generally out of luck.
If you think the information in your medical or billing record is incorrect, you can request a change, or amendment, to your record. The health care provider or health plan must respond to your request. If it created the information, it must amend inaccurate or incomplete information.
You have the right to review, copy, or amend your patient records. California Health and Safety Code (HSC) 123110(a). You also have a right to have someone go with you when you review your records.
Once you identify something you want to change, contact your healthcare provider and request a form for making amendments. Be clear with your request. Upon receiving it, your provider will have 60 days to act on your request. Your provider is not required to make the requested change.
Develop policies and procedures to address requested amendments. In ance with HIPAA, act on the requests within 60 days of receipt of the request. If the request is granted, make the changes to the medical record and send a written, signed, and dated response to the patient within 60 days.
If your provider has a form, and you want to fix a simple mistake, fill out the form and attach a copy of the health record page where you found the mistake. If your provider doesnt have a form or if the mistake is complex, you may want to write a letter describing the correction.
