Generally, the standard notice period for a landlord to end a tenancy in Ontario is 60 days before the end of the rental period or lease term, provided the tenant has lived there for less than a year. For tenancies longer than a year, the notice period may extend depending on the circumstances.
There are only two courses of action you can take with tenants staying past your lease. Either you have to treat your tenant as trespassers and legally evict them, or allow them to stay and continue to collect rent.
Yes, a landlord can ask a tenant to move out when a lease expires in Ontario. However, that request must be done at the right time and handled properly in order to be considered legally valid.
A verification form is a certification to prove or confirm the status of an individual. The process usually requires a third (3rd) party to provide documentation, such as a letter, as evidence. After the form has been completed, the party verifying the information requested should be signed.
The lease is renewed automatically on a month-to-month basis (if the rent is paid monthly) or week-to-week basis (if rent is paid weekly). This means the landlord and tenant do not have to sign a new fixed term lease when the term of the lease runs out.
Personal information that can be requested. When a prospective lessee submits an application to rent a dwelling, the lessor may demand certain information in order to establish their identity, behaviour and payment habits. The lessor may ask for the future lessees full name and complete current address.
If the landlord gives a tenant notice to end the tenancy and the tenant does not move out, the landlord can apply to the LTB for an order evicting the tenant. The tenant has the right to go to a hearing and explain why they should not be evicted or ask for more time to move out.
