The court will consider reopening a divorce settlement only in exceptional cases either where a spouse has failed to provide full and frank disclosure about their wealth and income in divorce proceedings or there has been a material change in a spouses circumstances since the agreement was docHubed.
To change an agreement or order, you need to provide information to the court about new circumstances. There must be something new that has happened for the court to revise the original agreement or order. If the agreement or order was made ing to the Divorce Act, you will need to apply to the Supreme Court.
Modifying The Terms of A Divorce As long as the changes are legal within the framework of Canadian law, there shouldnt be complications in submitting the new arrangement. Unfortunately, there are some situations where both spouses are estranged from each other, with one side refusing to change the agreement at all.
Simply put, until you get divorced, your old will remains valid unless you create a new will after your separation. And so, if your ex is named your executor or a beneficiary of your estate, those designations survive your separation until you formalize you divorce.
You can only apply to set aside your agreement if its filed with the court. This means you give the registry the copy of your agreement and they put it in a court file for you. If you havent already filed your agreement, see File your agreement in Supreme Court.
To do this, you will need a Certificate of Service (Form 9). Then the judge will hear evidence from all parties and decide whether to grant your Application. The names of the child or children in the case should appear here in the same way they appear on the order you are asking to change or cancel.
A Divorce Judgment, like any Order made by the court, can be appealed. There is a time limit for filing an appeal. In the case of a Divorce Judgment, this time limit is 30 days.
If youre not sure if you should change your agreement, you can ask for help. If you cant agree about changing the agreement and youve tried mediation, you might have to go court. The court can set aside (cancel) part of it, or even all of it, and replace it with a court order.
