Yes, Codicils are legally binding documents, provided they meet the necessary legal requirements of the jurisdiction in which theyre executed.
A codicil is a legal document. It is a stand a lone document that is separate from your will. It is this document that is used to modify or change a will. Without a codicil, it would be necessary to change your entire will to make even minor changes.
For a Codicil to be formally valid, it must be signed by the testator and two witnesses at the same time in the presence of each other. The witnesses must not benefit under the Will or the Codicil. The two witnesses should also date and sign the document.
In short, no a Codicil to a Will does not have to be docHubd. However, laws and requirements vary from Province to Province. A Codicil does have to be signed in front of at least two witnesses who are not listed as beneficiaries, guardians, or executors in your Will.
