Small entity status may be established by the submission of a simple written assertion of entitlement to small entity status. The assertion must be signed, clearly identifiable, and convey the concept of entitlement to small entity status. 37 CFR 1.27(c)(1).
In order to change entity status via Private PAIR, you must: (1) be a registered patent attorney/agent, an independent inventor, or a person granted limited recognition, (2) have a USPTO.gov account, (3) have a customer number, and (4) have two-step authentication.
A small entity is generally defined as a business which, including affiliates, has fewer than 500 employees, a qualifying nonprofit organization, or an individual who has not assigned, licensed or otherwise conveyed or promised to convey an interest in the invention to a non-small entity.
In order to change entity status via Private PAIR, you must: (1) be a registered patent attorney/agent, an independent inventor, or a person granted limited recognition, (2) have a USPTO.gov account, (3) have a customer number, and (4) have two-step authentication.
Unfortunately, under United States patent law you can not amend the patent to include the new subject matter reflecting the improvement you made to the invention. You will have to file a new patent application for the improvement to the invention instead of filing an amendment to the patent.
A patent transfer is usually accomplished through a contract, like the written agreement form that follows. However, after the parties have negotiated and signed their agreement, the transfer must be recorded with the U.S. Patent and Trademark Office (USPTO).
If you leave the company you wont be able to claim any rights on any patent you contributed to. The application for the patent wont be filed under your individual name, but under the name of the company, so once you leave the process is not affected.
