Review Your Lease. The first step to break your NYC apartment lease is to review the terms of your lease. Speak With Your Landlord. After reviewing your lease, youll need to speak with your landlord. Month to Month tenancies can be terminated by either the landlord or the tenant, for any reason, or for no reason at all, except if the reason is retaliatory (RPL 223-b). (See the Retaliatory Eviction handout for more information).
You will either have to pay an early termination fee, find a replacement tenant, or cover the cost of the remainder of your lease agreement. If you cant pay, your landlord may take you to small claims court or use a collection agency to recoup the rent.
A month-to-month tenancy may be terminated by either party. If the landlord plans to terminate, they must give notice on the same timeline as terminating non-regulated leases (as described on the previous page). Outside of New York City, the tenant must give one months notice to terminate the tenancy.
Landlords cannot charge more than one months rent for the security deposit, nor can they demand first and last months rent as a condition of occupancy.
In New York 5 Page 9 City, 30 days notice is required, rather than one month. Landlords do not need to explain why the tenancy is being terminated, they only need to provide notice that it is, and that refusal to vacate will lead to eviction proceedings.
California law allows landlord to change the terms of a month to month tenancy with proper notice. However, changing is not always as simple as just sending a notice.
