Like a will, a living trust can be altered whenever you wish. One of the most attractive features of a revocable living trust is its flexibility: You can change its terms, or end it altogether, at any time.
Suze Orman, the popular financial guru, goes so far as to say that everyone needs a revocable living trust. But what everyone really needs is some good advice. Living trusts can be useful in limited circumstances, but most of us should sit down with an independent planner to decide whether a living trust is suitable.
Many with revocable trusts choose to include a spendthrift clause and do so with good reason. A spendthrift clause can provide a strong layer of protection between trust beneficiary creditors and trust beneficiaries themselves.
The biggest downsides of a revocable trust include the following: Your trust assets arent protected from creditors. You may not qualify for needs-based Medicaid coverage for a nursing home because the assets held in trust are still counted as resources when determining benefits eligibility.
The surviving spouse still has the same power they had before their spouses death to amend the trust or revoke the trust. A revocable trust becomes irrevocable when the second spouse dies. The successor trustee will take over management of the trust, but will not have the power to change it.
(California Probate Code 15401-15402). The only way to amend an irrevocable living trust is to have the consent of each and every beneficiary to the trust. Once they all agree upon the amendment(s) to the trust, they can compel modification of the trust with a petition to the court.
These clauses ensure that each party to an agreement is clearly and unambiguously identified, setting out each partys correct full legal name and if not clear from a partys name, such partys status, or nature.
