In general, a leave of absence is applicable when the employees required time off is not covered under their employers existing benefits. Depending on the type of leave, the employee may be granted the time off with or without pay. For example, leaves for maternity and caring for a sick family members are unpaid.
It is not appropriate for an employer to determine what may or may not be urgent in an employees or student interns circumstance. Only when the employees or student interns reason is clearly not urgent and it is obvious that abuse is occurring, would it be appropriate for an employer to deny a personal leave.
You can request leave without pay for personal needs for either up to 3 months or for more than 3 months but up to one year.
Termination of employment Employees cant be terminated or laid off while on a job-protected leave unless the employer suspends or discontinues the business.
Employers in Alberta cant make docHub changes to a non-unionized workers job description or duties without their consent. When major modifications are made to the terms of your employment without your approval, the law allows you to resign and seek full severance pay through a constructive dismissal claim.
However, the total amount of leave taken by all cannot be more than 28 weeks within the 52-week period. You can consecutively take the leave related to critical illness to care for the same person if you are eligible.
Personal leave in Canada can be paid or unpaid, depending on certain conditions. Workers in this country get a personal leave of five days in a calendar year. Employees can take personal leave separately or at once. They must make sure that each period is at least one day long.
An employment contract cannot be changed solely because the employer revises the contract and the employee signs it. In order for the new contract to be enforceable, there must be a third component mutual consideration.
