Going to court If no agreement is possible, you can go to court to have a judge decide the matter. A judge can, for example: determine who is the owner and order that they be given possession of the pet, order that the contact stating how custody will be shared, in case of a break-up, be respected.
If the couple owns several pets, the court will divide the pets, and each person will keep several pets. If there is only one pet, the court must grant custody to only one spouse. In this case, the court must decide whether to treat the pet as property, person, or both.
In California, family courts consider pets as personal property, rather than as children or family members, which means they are treated similarly to other assets such as furniture or vehicles.
If a married couple is divorcing Many courts follow this general rule for dividing property: If one spouse acquired the pet before the marriage, that spouse will likely be allowed to keep it. If both spouses acquired the pet during the marriage, either spouse might be judged its owner.
The best solution is to settle pet custody outside of court, and to come to a mutual decision together. These can be hard conversations to have but, if you can, sit down with your partner and discuss what the arrangements for your pets future should be, and whether the decision you have made will be the best for them.
In California the judge determines custody of the pet. Effective January 1st, 2019, the law provides that pets are to be treated as more than community (marital) property during a divorce. The pets best interests and future welfare will be considered while determining pet custody in California.
If one person brought the pet into the marriage, then they will likely be awarded the pet during the divorce. However, there are many variables, such as who takes care of the pet, that the court may take into account. The first question that the court will address is whether the pet is separate or marital property.
Pet Responsibility and Care Each party agrees to provide the pet(s) with excellent food, water, and maintenance. They also agree to offer care related to training and grooming. Both parties agree to license and register the pet. The person with primary ownership would be registered as the pets owner in the papers.
