Employees falsifying time cards violates ethical standards and legal regulations. Although it is not a specific federal crime, timecard fraud can fall under various criminal statutes.
The FLSA requires employers to have accurate and up-to-date information on time cards and all items listed above. If an employer falsifies timesheets, they can face lawsuits, fines, and potentially even criminal charges.
Timesheet manipulation or fraud, also known as time theft, occurs when employees deliberately overstate or provide false information about the hours they have worked in their timesheets, resulting in unjustified payments.
Under the FLSA, however, employersnot the employeeshave the ultimate responsibility to maintain these records. For this reason, employers have the ability to change employee time records but must ensure that the records accurately reflect the time actually worked.
Any changes or corrections to an employees time card or time record must be initialed by the employee and [his or her supervisor/other job title]. Under no circumstances may any employee punch or record another employees time card.
