Here are the key reasons a consumer proposal might get rejected: You are offering insufficient funds. You are offering an unsuitable repayment schedule for your creditors. You contributed to your financial situation by an unjustifiable extravagance in living expenses or by neglecting business matters.
When you file for a consumer proposal, you will have to hand in any credit cards that are part of the proposal. The creditors will freeze or close the credit card for which you previously qualified. You might have a credit card with a zero balance or a credit balance not included in the proposal.
Here is a list of Albertas bankruptcy exemptions: You are entitled to keep the necessary clothing for you and your dependents. You can keep enough food to support you and your dependents for up to 12 months. You can retain up to $4,000 in home furnishings and appliances. All medical and dental aids are exempt.
Can you get a credit card after Chapter 7 bankruptcy? Yes, you can get a credit card after Chapter 7 bankruptcy. A good option is the Platinum Secured Credit Card (see Rates Fees), thanks to its $0 annual fee and the potential for a credit limit higher than your deposit.
Paying off debt with a consumer proposal will negatively affect your credit. You will get out of the unsecured debt you owe in 60 payments or less. The agreement is legally binding, so if you break it you will not receive a refund on the fees that you paid.
Only when you file bankruptcy would any contributions made in the past twelve months need to be surrendered to a Licensed Insolvency Trustee. A consumer proposal also allows you to keep any savings, RESPs, and other investments you may have contributed to.
Tip: Before making your proposal or filing bankruptcy, you and the joint account holder should open separate bank accounts. Your partner may open their account at the same financial institution and apply for overdraft or a line of credit, but we recommend you switch banks.
When a person files for bankruptcy, they are required to turn over all credit cards to their Trustee. Whether there is a balance owing or not. Exceptions An exception would be a 3rd party card (such as a company expense account card).
