why are you damn lawyers afraid to appeal or respond to an noir hi im jim hacking immigration lawyer practicing law throughout the united states at our offices in st louis san diego and washington d.c one of the youtube commenters was complaining the other day saying all these damn immigration lawyers are afraid to fight on a case and they always tell you to refile while i understand the sentiment and i understand the frustration i suspect that the reason why most immigration lawyers who know what theyre doing tell you to abandon a flawed case is if theres a way to reset the clock or reset the process and refile with greater information greater documentation and a stronger case youre always going to be better off or almost always going to be better off doing that than filing an appeal the problem with appeals is they go into a black hole nobody ever really responds to them nobody really looks at them in any timely fashion weve seen appeals take 18 months and if the underlying case

For most appeals, appellants must file an appeal on Form I-290B within 30 calendar days after personal service of the decision, or 33 calendar days if the decision was mailed. An appellant must file an appeal of a USCIS decision to revoke the approval of an immigrant petition upon notice under 8 C.F.R.
An immigration appeal may take between 6 months and 1 year to resolve.
The I290B (MTR or Appeal) is a very long process, which may take up to 2 years. The chances of getting Approval is very slim. You must have substantial evidence to file an MTR. Your Attorney must present an extreme case; if theUSCIS denied the H1B in error, you have a high chance.
If you get your correction to USCIS early enough, it might accept your correction and start work on your form.
