I have a revocable living trust in my name I am the trustee and I have two alternative trustees in sequence depending on whos available at the time of my passing got it my question is I need to change the person for the second alternative alright can I do that with an addendum to the trust or do I have to go through someone like yourself an attorney to have that done well it is done through an amendment to trust that amendment must be done with the same formalities when you sign your original trust which means two witnesses in a notary public so could you change it the answer is yes theres no law that requires that an attorney does it but make sure you got to witness isnt a notary public to it now you had a simple answer for my simple question I really appreciate that hey Larry I want to say one more thing when you did your living trust you did a whole package of documents you did a pour-over will powers of attorney living will etc on all those documents you had a first and second c

The name of the trust is the name of the trust and will continue to include revocable in its title and on investment accounts held by the trust.
The simplest way to make a change to a living trust is with a trust amendment form. A living trust amendment allows you to make changes to an existing trust while keeping the original document active. If you have a joint trust with your spouse, you both must agree to any changes to the trust.
Disadvantage: You Must Retitle Assets This means that assets typically need to be retitled. For example, if you want a trust to own your home, youll need to draft a new deed with the trust as owner. The same is true if you want the trust to own your car or boat. Some assets do not have a title.
The Trustee elects to change the name of the Trust and then confirms that election in writing. A Trustee must ensure that if a Trust changes its name that every person who has business dealings with the Trust deed and every Nominated Beneficiary of the Trust is notified of the change of name.
A revocable trust can absolutely be changed as long as its creator is alive and has mental capacity. Such changes may include who is in charge of the trust when the creator becomes incapacitated or dies, who will benefit from the trust, and any restrictions or protections the creator wants over the assets in the trust.
The trust documents will outline the rules and limitations for a beneficiary withdrawing money from the trust. If allowed by the trust, the beneficiary can request a withdrawal distribution from the trustee ing to the trusts rules and guidelines.
The trust deed stipulates the name of the trust and any amendment thereof will require an amendment to the existing trust deed. However, in order to have the name of a testamentary trust (a trust created upon your death in your will) changed, one will have to apply to Court.
A living trust can be revocable** or irrevocable, depending on the preference of the settlor. A revocable living trust can be terminated by the settlor at any time, although there may be corresponding tax implications for doing so. * The settlor cannot be the only trustee in Quebec.
