Changing your date of birth would lead to one of two results. One, the employer would find no information on you, which is puzzling. It would lead to follow-up questions to correct the mistake. Two, if your name matched with a different date of birth, cross-checks would flag a problem.
Federal law does not prohibit employers from asking employees or job applicants about their age, including in application materials and background checks. However, asking about a persons age could discourage older workers from applying to jobs because of fear of possible discrimination.
Employers should not be asking for a job applicants date of birth. It is the same as asking an applicant how old they are. Asking for the information is not, in itself, illegal but it certainly can be used as evidence of age discrimination and is frowned upon by the California Dept.
In 1967, the Age Discrimination in Employment Act (ADEA) was signed into law to forbid ageism in the workplace against anyone 40 or older. Any interview question that asks about your age or infers how old you are is employment discrimination and illegal for interviewers to ask period.
You must understand that federal and state laws do not prohibit a prospective employer to inquire about your age or date of birth. Though, the purpose behind inquiring must be lawful. In other words, they cannot ask about your age if they have a possible intent to discriminate against you based on your answer.
The decision to disclose ones age on a resume ultimately depends on the specific circumstances surrounding a job application. In certain industries and positions, age might be less relevant, while in others, it could signal maturity and expertise.
While the employer can ask a job applicant for their date of birth (DOB) and proof of age, they must only use this information for legal purposes and cannot use a DOB to discriminate against applicants based on age. For instance, an employer can ask for a DOB to perform a background check.
i) Age: No questions about age are permitted on an application form, other than whether an applicant is 18 years or over. Employers should not ask for the date of birth or a birth certificate, or for other documents that indicate age (such as baptismal records, drivers licence, etc.).
