hi this is Rush nugget Im an Iowa franchise and business lawyer one of the inquiries that I received on my blog recently was whether or not a spouse should sign a franchise agreement most franchisors will require personal guarantees from franchisees so if a spouse is not going to be involved in the business I usually recommend that that spouse not sign the franchise agreement the reason is because from a an asset protection point of view I think you can do better planning for your family if both spouses are required to personally guarantee the debts obviously youre throwing all your eggs in one basket but if one of the spouses hasnt signed and isnt responsible you can then shift some assets to make sure that you protect yourself now some franchisors will tell you that the spouse is required to sign but that usually isnt the case and most franchise agreements will contain transfer Provisions that allow a spouse to transfer to another spouse in the event of death or other circumstan
