The IRS notes that items with a value greater than $100 cant be a de minimis benefit. In practice, this means you could give each of your employees a gift with a $100 value or less, and the gift would qualify as de minimis and be tax-free. A gift must be a tangible item for the IRS to consider it a de minimis benefit.
When you record gifts to employees in your books, if the gift must be included in the employees taxable compensation, post it to the same account to which youd post their salary, wages, or bonuses. If the gift is not considered compensation, record it under employee incentives.
If you give a gift to an employee, it is generally considered a personal expense. This is because the gift is given with the intention of showing appreciation for the work that the employee has done. For example, you may give an employee a gift to celebrate their birthday or to thank them for their hard work.
For the Business - Cash gifts are a tax deduction for the business. For the Employee - The gross amount of the gift is taxable for the employee.
The bottom line: no matter the amount, a gift card given to employees is not considered a de minimis fringe benefit. Instead, it should be included in wages on Form W-2 and subject to tax withholdings.
The company cannot record revenue when the gift card is purchased since the company is obligated to provide service at a later date. Therefore, the income is deferred and recorded as an obligation until the customer redeems a gift card, service is provided, and contract terms are satisfied.
Gifts awarded for length of service or safety achievement are not taxable, so long as they are not cash, gift certificates or points redeemable for merchandise. Tax-free value is, however, limited to $1,600 for all awards to one employee in a year.
The IRS considers bonuses, gifts, and rewards in the category of supplemental wages. How you withhold from employees on supplemental wages depends on whether the payment is separate from regular wages (like a separate bonus check).
Most gifts to employees are taxable to them. If they are taxable income to the employee, you must withhold federal, state, and local income taxes and deduct the employees share of FICA taxes (Social Security and Medicare taxes). You must also pay unemployment tax on these amounts.
