The Madrid Protocol is an international system for obtaining trade mark protection in a number of countries and/or regions using a single application. Protection (an International Registration) can only be obtained for countries and regions which have joined the system (member countries), and these are listed below.
A trademark can be revoked for the following reasons: A trademark can be revoked if the trademark owner has not taken the trademark into use within five years of the registration, or if such use has been suspended for five successive years.
Any person aggrieved by the registration of trademarks may apply to get it cancelled. An aggrieved person is the one who is affected adversely by the trademark. A person interested in a trademark can apply for its cancellation. Though any person can apply for it, he can do so only on the grounds mentioned in the Act.
A cancellation is the removal of a trademark registration from the register in response to the filing of a cancellation action. The proceedings are initiated when a party with standing files a cancellation action with a designated administrative body within the trademark office or with the responsible court.
It is not yet possible for you to cancel your international trademark registration i.e., remove some or all of the goods and services in respect of all of the designated Madrid System members through eMadrid. For now, you should use Madrid System Form MM8.
The international registration of your mark is valid for 10 years. You can renew the registration at the end of each 10-year period directly with WIPO with effect in the designated Contracting Parties concerned.
The Madrid Protocol does not provide for the filing of divisional applications. This means that if you receive an objection in one class, there is no way to proceed to registration in other classes until the objection is addressed.
