A trademark opposition seeks to block a trademark application from registering. A trademark cancellation seeks to cancel a registered mark. Therefore, oppositions relate to pending applications whereas cancellations pertain to registrations.
Registering your trademark with the U.S. Patent and Trademark Office (USPTO) gives you trademark protection throughout the United States, but it does not protect your trademark in other countries. To protect your trademark abroad, you need to register it with the foreign countries where you want protection.
How can you revive a canceled trademark registration? The USPTO will usually send a notice of cancellation or expiration. Within two months of the date of the cancellation/expiration notice, the registration owner must file a petition to revive with all the necessary requirements and fees.
A petition for cancellation of a trademark registration may be filed at any time. However, a mark which has been registered for more than five years may only be cancelled on the grounds enumerated in Trademark Act § 14.
When a trademark is revoked or invalidated, it is removed from the register and the trademark right is terminated either entirely or in part. The trademark is deemed not to have been valid, as from the outset, to the extent that the trademark has been invalidated.
When should you renew your international trademark registration? You can renew your international trademark registration at the earliest three months before the ten-year term of protection expires, or within the six-month grace period following its expiry.
A trademark cancellation proceeding is exactly what it sounds like. It's a legal case, similar to a civil lawsuit (although it is by contrast processed in the Trademark Trial and Appeal Board (TTAB)), in which a complainant is provided with the opportunity to attack and ultimately cancel a defendant's trademark rights.
Some attorneys (including myself) offer a registrant a flat-fee to try to amicably resolve the cancellation (instead of litigate it). But, that flat-fee will probably be at least $1,000-$1,500.
Abandonment / Nonuse Competitors may seek to cancel a registration on the basis of nonuse and/or abandonment. In such cases, registration owners can build a helpful defense by keeping good records of continuous use of the mark from the registration date to the present.
