Information known publicly before the effective filing date of a U.S. patent application is called prior art. Prior art may be published on paper or electronic format. Websites, social media, and various other forms of online publications are frequently cited as valid sources of prior art.
U.S. patent application publications are prior art under pre- 35 U.S.C. 102(a) and 102(b) and 35 U.S.C. 102(a)(1) as of the publication date. Under pre- 35 U.S.C.
Information that becomes publicly disclosed or publicly available only after your applications filing date generally doesnt qualify as prior art.
