hi this is greg maxwell i wanted to just chat with you a little bit about the differences between structuring your attorney fees using a structured settlement annuity versus using a deferred compensation plan so both have advantages and disadvantages one isnt necessarily better than the other it just depends on what your goals are and what youre looking to accomplish the advantages of a structured settlement annuity i think are number one if you know exactly when you want the funds paid to you in the future and you want guarantees i think a structured settlement annuity is a great fix essentially at the time of settlement you decide when and and in what amount youre going to receive those future payments so if youre looking to set up a guaranteed retirement plan for the rest of your life for example you can have those payments start at age 65 or 70 or whenever you plan to retire and pay for the rest of your life you can even do a joint life annuity with your spouse to make sure tha

The employer may terminate and liquidate a nonqualified deferred compensation plan in the event of a change in control event as defined in the final regulations under 409A.
How Is a 457 Withdrawal Taxed? A 457 withdrawal is taxed as ordinary income and is not subject to IRS premature withdrawal penalties.
Regardless of your age, you are not subject to a 10% early withdrawal penalty on distributions of 457(b) plan contributions and earnings. However, you may be subject to the 10% early withdrawal penalty tax for withdrawals of non-457(b) plan rollover funds that you moved into the plan.
Exceptions to the 10% additional tax apply to an early distribution from a traditional or Roth IRA that is: Made to a beneficiary or estate on account of the IRA owners death. Made because youre totally and permanently disabled.
Disadvantages for key employees include limits on annual contributions, required minimum distributions after docHubing a certain age, and a 10% penalty for early withdrawals. Consequently, some employers use a nonqualified deferred compensation ( NQDC ) plan for their key employees.
You can take penalty-free withdrawals from your 457 account at any age after you leave your job. Most other types of retirement-savings plans assess a 10% penalty if you withdraw money before age 55 or 59, depending on when you leave your job.
This payment is immediately taxable (see the note below) and is subject to mandatory 20% federal income tax withholding. State income tax withholding may also apply. Complete section 2 of the 457 Basic Withdrawal form.
The Bottom Line. If you have a qualified plan and have passed the vesting period, your deferred compensation is yours, even if you quit with no notice on very bad terms. If you have a non-qualified plan, you may have to forfeit all of your deferred compensation by quitting depending on your plans specific terms.
